1. Agreement to Terms

By accessing and using ServeNest ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our Service.

These Terms constitute a legally binding agreement between you and ServeNest, governed by the laws of England and Wales.

2. Service Description

ServeNest provides a multi-tenant restaurant management platform that enables:

  • Online order management and processing
  • Menu creation and management
  • Integrated payment processing via Stripe
  • Analytics and reporting tools
  • Customer engagement and marketing features

3. Account Registration

To use ServeNest, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 18 years old or have legal guardian consent
  • Operate a legitimate restaurant or takeaway business
  • Promptly notify us of any unauthorised use

You are responsible for all activities under your account.

4. Subscription and Billing

Free Trial

New accounts receive a 14-day free trial. No payment is required during the trial period.

Subscription Plans

  • Subscriptions are billed monthly in advance (£29/month starting price)
  • Payment is processed via Stripe on your billing date
  • Prices are in British Pounds (GBP) and exclude VAT where applicable
  • Price changes will be notified 30 days in advance

Cancellation

You may cancel your subscription at any time. Upon cancellation:

  • Access continues until the end of your current billing period
  • No refunds for partial months
  • Your data will be retained for 30 days before deletion

5. Acceptable Use Policy

You agree NOT to:

  • Violate any laws or regulations
  • Infringe intellectual property rights
  • Transmit malicious code or viruses
  • Attempt unauthorised access to our systems
  • Use the Service for fraudulent purposes
  • Resell or redistribute the Service without authorisation
  • Interfere with other users' access to the Service

Violation may result in immediate account termination without refund.

6. Intellectual Property

ServeNest retains all rights to:

  • The ServeNest platform, software, and technology
  • Our trademarks, logos, and branding
  • Documentation and support materials

You receive a limited, non-exclusive license to use the Service during your subscription period.

7. Data Ownership

You own your data. This includes:

  • Restaurant information and menus
  • Customer data and orders
  • Transaction records

We may use aggregated, anonymised data for analytics and service improvement.

8. Service Availability

We strive to provide:

  • 99.9% uptime (excluding scheduled maintenance)
  • Advance notice of planned maintenance
  • 24/7 system monitoring

However, we do not guarantee uninterrupted access. Downtime due to factors beyond our control (infrastructure providers, DDoS attacks, etc.) is not breach of contract.

9. Limitation of Liability

To the maximum extent permitted by UK law:

  • ServeNest is provided "as is" without warranties of any kind
  • We are not liable for indirect, consequential, or punitive damages
  • Our total liability is limited to fees paid in the 12 months prior to the claim
  • Nothing excludes liability for death/injury, fraud, or statutory rights under the Consumer Rights Act 2015

10. Termination

We may suspend or terminate your account if:

  • You violate these Terms
  • Your payment fails and is not resolved within 7 days
  • Your account remains inactive for 12+ months
  • Required by law enforcement or court order

Upon termination, you must cease use of the Service and export your data.

11. Dispute Resolution

Governing Law: These Terms are governed by the laws of England and Wales.

Jurisdiction: Any disputes will be resolved exclusively in the courts of England and Wales.

Informal Resolution: Before formal proceedings, we encourage contacting us at legal@servenest.co.uk to resolve disputes amicably.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via:

  • Email notification (at least 30 days' notice)
  • In-app notification
  • Updated "Last Modified" date on this page

Continued use after changes constitutes acceptance of the new Terms.
